Privacy Policy Surgeon Locator

This Privacy Policy is provided by Orthofix S.r.l. (“Orthofix” or “we”), as data controller according to the Regulation (EU) 2016/679 (“GDPR”), to inform you about the processing of your personal data that may be carried out in connection with a new feature that was developed on our informative website www.limbhealing.com (“Website”)

Such novel feature, named ‘Find a surgeon’, aims to enable patients and/or other interested parties to retrieve contact information, by geographic area, for surgeons or specialists who have received training on and are authorized to use one or more of the Orthofix limb reconstruction devices/applications listed in the footer of the Website  (the “Surgeon Locator”).

This document shall complement and not replace the privacy policy of the Website (link) and the privacy policy that was provided to you when you received your access credentials for the TL-HEX, which shall therefore remain fully valid and applicable also in relation to data processing activities related to the Surgeon Locator (link). Accordingly, please refer to that policy for any additional information which is not expressly provided herein (Article 13.4 of the GDPR).

1. Categories of Personal Data processed

If you wish to join the Surgeon Locator service, you must provide us with the following data: first and last name; medical specialty (e.g. congenital deformity specialist, or foot and ankle specialist, or trauma and post-trauma specialist), business address, including city, ZIP code and country; name of the hospital you work for and department name (both if applicable); email address; telephone number (all together the “Personal Data”).

2. Purposes and legal bases of the processing

We will collect and process your Personal Data with the main purpose of including them in the Surgeon Locator feature, so to allow patients and/or other interested parties to easily find your contact information on the Website. The legal basis to process your Personal Data for this purpose is your prior and specific consent (Art. 6.1(a) of the GDPR. The provision of such a consent is voluntary, but without it, we will not be able to include your Personal Data in the Surgeon Locator. 

In addition, we may process your data to comply with applicable laws and regulations, pursuant to Art. 6.1, let. c) of the GDPR, including in order to fulfil the competent authorities’ requests, and/or on the basis of our legitimate interest under Art. 6.1, let. f) GDPR, for the purposes of defending our rights in courts or in the context of extraordinary corporate operations.

3. Who will process your Personal Data

Your Personal Data may be disclosed to and accessed only by duly authorized personnel within Orthofix, and/or by third parties, including other companies belonging to the Orthofix Group, that provide services functional to the achievement of the purposes set out above. 

These recipients will process your Personal Data acting as autonomous data controllers, data processors on behalf of Orthofix or authorized personnel, as the case may be.

Moreover, your Personal Data may be communicated to third parties, if required or permitted by the applicable laws, including pursuant to a Court order, to government authorities or to law enforcement agencies.

4. Transfers of Personal Data

For the purposes described above, your Personal Data may be transferred to countries outside the European Economic Area (“EEA“) that do not guarantee an adequate level of protection. In particular, your Personal Data may be transferred to other companies of the Orthofix Group, which are located outside the EEA (e.g. Orthofix Inc. in the United States). In such a case, Orthofix will take the necessary measures to protect your Personal Data, including the adoption of Standard Contractual Clauses approved by the European Commission, in accordance with the applicable law and in particular Articles 45 and 46 of the GDPR.

5. Data retention

Your Personal Data will be kept in identifiable form for no longer than necessary to allow your enrollment in the Surgeon Locator service, and in any case within the time limits set forth by the legislation in force, e.g. to protect our rights, where necessary. When no longer needed in accordance with the above, the data will be cancelled.

6. Your Rights

At any time you can exercise your rights under the GDPR, in particular:

    a) the right to access your Personal Data, by obtaining any further information regarding the  relevant processing activities;

    b) the right to have your Personal Data duly rectified;

    c) the right to have your Personal Data deleted, in the cases provided for by the applicable  laws;

    d) the right to restrict the processing of your Personal Data, where applicable;

    e)  the right to object to the processing of your Personal Data, where applicable;

    f) the right to withdraw your consent  at any time, without this affecting the lawfulness of  processing based on consent before its withdrawal;

    g) the right to data portability of your Personal Data, namely receiving them in a structured, commonly used and machine-readable format, where applicable;

    h) the right to lodge a complaint with the competent data protection Authority.
